Court adjourns female banker's dollars scam to August 10
Adebola had filled a motion on notice praying the court to merge another case pending before the same court where she challenged the person whom she claimed she gave the customer’s money to.
In her motion on notice dated June 5, 2014, Adebola said that she gave N1,457,000 given to her by the customer to the accused in the case sought to be merged for foreign exchange transaction who failed to return the money or dollars equivalent.
According to her, emerging or consolidating the case will afford the court the opportunity to effectually and effectively determine her case.
The affidavit in support of the motion on notice depossed to by Barrister Isiaka Abdulrasheed of Jawondo & Co, Ilorin reads: “that the accused in the case sought to be merged or consolidated was the only one who can explain whereabout of the money for which she is standing trial.”
Oppossing the application, the victim, Mr. Segun Oladipo said that it was the accused that he gave the sum of N1,457,000 and not the person sought to be joined as co-accused and that there was no time the accused informed him that the money was given to person sought to be joined in the case.
According to counter-affidavit dated June 16, 2014 and filled by the counsel to the victim, Barrister S.A. Shogo, the emerging of the cases will prejudice the victim because he has no claim against anybody except the accused.
He agured that granting the application will frustrate the proper determination of the case and that it was only a ploy to delay the cause of Justice in the case.
Adebola was standing trial for criminal breach of trust and cheating, contrary to Sections 322 and 320 of Penal Code Law.
The trial judge, Chief Magistrate N.K. Ajide, however, adjourned the case till August 10 for the motion on notice.
