Saraki Advises LAK Jimoh to Drop Case

The former governor of Kwara State, Senator Bukola Saraki, has advised Alhaji L. A. K. Jimoh, a senatorial aspirant in the Peoples Democratic Party (PDP) 2011 primaries election to change his mind on the appeal and come to term with the party's guideline on party primaries.

Saraki, who is the senator representing Kwara Central Senatorial district, spoke through his lead counsel, Lateef Fagbemi (SAN), who is leading six other lawyers to challenge the jurisdiction of the Federal High Court and the Court of Appeal to hear the case, also urged the appellate court to decline jurisdiction and also dismiss the appeal in its entirety.

He maintained that the PDP fully complied with its guildlines in submitting the name of Saraki as its candidate in the election.

Fagbemi who cited various legal authorities, stated that "assuming, without conceding that the PDP did not follow its guildline, the remedy is not to accede to the cancellation of the nomination as being canvassed but for the appellant to seek damages."

He, therefore, advised the appellant to change his mind on the appeal.

The presiding justice, Justice Yahaya, leading two other justices, reserved judgment.

The Federal High Court sitting in Abuja, had earlier dismissed the case instituted by Jimoh as "unmeritorious" and affirmed the candidacy of Saraki as the duly elected candidate of the PDP in the election.
