Kwara court dissolves 3-month barren marriage over battery

A Kaiama Area Court in Kwara on Monday dissolved the three-month-old childless marriage between a man, Bello Mairuwa, and his estranged wife, Aishat, over battery.

The judge, Ahmed Yahaya, said the couple should go their separate ways since the marriage had broken down irretrievably.

Yahaya chided the husband for his absence at the proceedings after being duly served court's summons.

He, however, ordered her to observe the three months Iddah (the Islamic period of waiting after death or divorce), before remarrying.

He said any aggrieved party had a right to appeal at an Upper Area Court within 30 days of the judgment.

The News Agency of Nigeria (NAN) reports that Aishat had approached the court seeking the dissolution of the union.

"I cannot endure the relationship again. He beats me at the slightest provocation.

"I want the marriage dissolved since it is not blessed with a child," said Aishat, who resided at Gwaria Village, with her former wife. (NAN)
