Stop Dumping Cases in my Court, Judge Warns Litigants

An Ilorin Area Court judge, Mr Abdulkadir Ibrahim-Umar, on Thursday warned litigants against dumping cases in his court.

Ibrahim-Umar gave the warning in Ilorin before striking out a case filed by the Kwara Environmental Health Office against one Abdulraheem Anafi for lack of diligent prosecution.

The judge struck out the case after parties in the dispute failed to appear before the court.

The Environmental Health Office had on June 26 filed a three-count charge against the accused.

Anafi was charged with lack of toilet facilities in his house, blockage of access road and non-compliance with abatement notice served on him.

The accused, who appeared in court on Aug. 1, pleaded guilty only to the charge of lack of toilet facilities.

This prompted the prosecution to request for adjournment to enable it gather evidence against him on the other charges.

The prosecution had failed to appear in court twice since then.

But in his ruling, Ibrahim-Umar said: "I will not want this court to be a dumping ground for cases.

"In view of the absence of the parties in this case, I hold the case to be struck out and it is accordingly struck out for lack of diligent prosecution." (NAN)
