Reinstated Kwara lawmaker seeks N5bn damages
As the tenure of 7th Kwara Assembly wound up yesterday, one of the members who represented Malete/Ipaye/Oloru constituency, Hon. Iliasu Ibrahim, has filed a motion before the state High Court demanding the payment of N5 billion as damages for his alleged unlawful suspension.
The lawmaker, a member of the Peoples Democratic Party (PDP), was suspended twice from the House but the state High Court and Court of Appeal nullified his suspension, declaring that he should be reinstated and his salaries and allowances paid.
Though the House filed a motion for stay of execution of the High Court judgement delivered on June 16, 2014, the motion was dismissed prompting the 'suspended' lawmaker to resume at the House. He was however turned back twice by security men at the gate of the House.
The lawmaker had earlier filed a motion seeking to commit the speaker to prison. The motion has been slated for hearing on 9th June before Justice E.B Mohammed.
The lawmaker has however approached the court with a fresh motion seeking the payment of N5bn as damages against the House for allegedly depriving him of representing the electorate of Malete, Ipaye and Oloru.
Joined as respondents in the motion are the House, the outgoing Speaker and Deputy Speaker, Professor Mohammed Gana Yisa.
While the lawmaker is seeking damage of N2bn, the three other claimants are demanding for the payment of N1bn each "as general damages for the unlawful and unconstitutional deprivation of representation in the Kwara State House of Assembly for a period of over one and half years by the defendants contrary to the provisions of sections 104, 105 (1) and 110 of the 1999 constitution as amended."
In the originating summon containing the grounds of the motion obtained by Daily Trust, the reinstated lawmaker noted that the three months' suspension without pay was set aside and declared a nullity by a high court subsisting judgement but the defendants have refused to comply with the judgement.
