Kwara PDP chairman in court for contempt

Chairman of Kwara State chapter of the Peoples Democratic Party, PDP, Iyiola Oyedepo, was yesterday docked at an Ilorin High Court for alleged contempt of the court.

The state chairman was absent at the court without reasons on Tuesday, hence, the order for his appearance, yesterday.

Justice Isiaka Yusuf of the Kwara State High Court had on Tuesday ordered the PDP chairman to appear before the court to respond to allegation of contempt levelled against him by a factional chairman of the PDP in Ilorin West Local Government Area, Alhaji Toyin Olosasa.

Trouble started when Oyedepo on the Wednesday, September 3, 2014 swore in the Alhaji Yusuf Amuda Olugbon-led PDP executives in the local government, claiming that he had not obtained the court's order before the inauguration.

Counsel to the applicant, Mogaji Oba Abdulkadir, told the court on Tuesday, that Oyedepo's absence in court without any reason was "clear disobedience to the court order."

Abdulkadir prayed the court to issue a warrant of arrest against Oyedepo and compel his court attendance.

In his submission, Oyedepo's counsel, A. O. Abubakar argued that the process of the contempt proceeding was "pre-matured and defective," saying the defendant was entitled to seven days to file response to the allegations in accordance with Order 11 Rules 1 and 2 of the court.

The Judge in his ruling on Tuesday agreed with applicant's counsel that Oyedepo's absence was a disobedience to the court order, hence, he ordered him to appear on Wednesday to respond to the contempt charges.

However, upon his appearance, yesterday, Oyedepo's counsel filed a counter-affidavit challenging the processes of the contempt proceeding as well as the jurisdiction of the court.

The applicant counsel, Abdulkadir asked the court for short time to file responses to the counter-affidavit.

In his ruling, the Justice Yusuf adjourned the case till Monday, September 15, 2014.
