Kwara Governorship: Ahmed, Belgore to know fate tomorrow
There is tension in political circles in Kwara State as the Supreme Court is set to deilver judgement in the gubernatorial appeal brought to it by Alhaji Dele Belgore of the Action Congress of Nigeria (ACN). The appeal is against the judgment of the Federal court of Appeal in Ilorin which affirmed the earlier judgment of the Kwara State Governorship election petition which dismissed Belgore's case against Alhaji Abdulfatah Ahmed of the People Democratic Party (PDP). The judgement is to be delivered tomorrow (Monday).
Alhaji Dele Belgore filed an 18-ground appeal challenging the ruling of the Court of Appeal on January 7 which upheld the ruling of the Election Petitions Tribunal which dismissed his petition against the election of Abdulfattah Ahmed as governor of the state. Furthermore, the ACN said in its notice of appeal that the Appeal Court failed to make pronouncements on several issues of law raised in the case of the petitioners - ACN, Belgore, and his running mate, Engineer Adeyinka.
Alhaji Yusuf Olaolu Ali, SAN, who appeared for Alhaji Abdulfatah Ahmed , argued that the appellants' appeal is against concurrent findings of two lower courts and that the appellants have been unable to show any justification to warrant interference with the concurrent findings of the two lower courts.
Ali argued further that Alhaji Dele Belgore has failed to prove the myriad of criminal allegations and substantial non-compliance with the electoral acts as contained in the petition. He therefore urged the justices to affirm the judgments of the two lower courts by upholding the election and return of Alhaji Abdulfatah Ahmed and dismiss the petition in its entirety.
