Sacked PDP lawmaker: KWHA awaits Appeal Court ruling

The Kwara state House of Assembly resolved to continue to allow the sacked lawmaker, Hon. Salman Abdulfattah, to sit at plenary until Court of Appeal gives its final ruling on the matter.

The Action Congress of Nigeria (ACN) had urged the Assembly to stop the PDP member from sitting and participating in debates on the floor of the House because he had been sacked by an Ilorin High Court in a suit injstituted against him by Abdul Kayode Aiyelabegan, the party’s candidate in the 2011 state Assembly elections.

The Assembly in a statement signed by the Special Assistant to the Speaker, Abdulrahaman Sanni, stated that it resolved that it was a party to the suit and there was no where in the judgment that ordered that Hon Salman should vacate his seat.

"However, the matter was referred to the lawyers to the Assembly. They have advised that since there is a pending appeal by Hon. Salman and the Assembly has not been notified of the outcome of that appeal, the matter remains subjudice. As such, it would be improper to take any action.

"The Kwara state House of Assembly always respects court judgments and orders. However it is foolish to rush to take action one way or the other without the legal position being made clear and unambiguous. Otherwise, we might ourselves run foul of the law."
