'UNILORIN 44' Asks Court To Commit VC, Three Others To Prison
The sacked 44 lecturers of the university of Ilorin who were reinstated by the Supreme Court have applied for an order of the Ilorin Federal High court to commit to prison the vice chancellor and three other officials of the university for "neglecting to obey the judgment of the Supreme Court contained in its judgment delivered on 11/12/2009."
The Supreme Court had in the judgment reversed the sacking of the lecturers by the university in 2001, but the lecturers are claiming that the school had refused to implement the reliefs granted them by the Supreme Court.
Some of the reliefs that the university management had allegedly refused to implement included their accumulated annual leaves and promotions as reportedly contained in the apex court's judgment.
The lecturers who made their application via a motion on notice are also seeking that the judgment debtor-respondents be "detained in custody until they obey the judgment in all things that ought to have been granted to the judgment-creditors according to the judgment."
The motion on notice signed by the applicants' counsel, Toyin Oladipo is slated for hearing on May 25, 2012.
The applicants' grounds of application included that: The Supreme Court delivered its judgment on this case on appeal on 11/12/2009 wherein it restored the judgment of the High Court,thereby granting them all their reliefs.
"The judgment debtors have refused to grant the judgment creditors their accumulated annual leaves and sabbaticals for the period they were unlawfully dismissed;
"The judgment debtors have refused to grant the judgment creditors their annual promotions for the period they were unlawfully dismissed, and that;
"Forms 48 and 49 have been served on the judgment debtors and they still persist in their disobedience."
