A 60-year-old man, Mohammed Saliu and his son, Saliu Mohammed,30 both farmers at Esie Village, Irepodun Local Government Area of Kwara State, have been arraigned before an Ilorin Chief Magistrate Court for allegedly killing a cattle rearer.
The accused were arraigned on a three-count charge of criminal conspiracy, causing grievious hurt and culpable homicide. The offences contravene Sections 97, 248 and 221 of Penal Code Law.
Trouble began when on August 12 one Baleri Ibrahim and Gambo Ibrahim both of Fulani Camp, Esie Village allegedly grazed their cattle into the farm of the accused and destroyed all their farm crops.
The cattle rearers were said to have taken to their heels on sighting the farmers.
However, the accused allegedly trails the herdsmen to the camp of one Umar Ibrahim where they were expressed their grievance.
It later resulted into a hot argument which metamorphosed into a fight between the accused and the cattle rearers.
According to the Police First Information Report (FIR) on the matter, in the course of the fight the accused shot one Mohammed Ibrahim to death and also inflicted grievous injury on one Abu Ibrahim.
The FIR added that the accused committed the offences.
The prosecutor, Corporal Sanni Abdullahi, who informed the court that investigation into the matter was yet to be completed, objected to the bail of the accused and urged the court to remand them in prison custody, Ilorin, pending the outcome of the investigation.
The defense counsel, Barrister Sunday Ike, prayed the court to admit the accused to bail since the law still presumed them innocent of the allegation until contrary is proved.
The judge, Mrs. M.B. Magaji upheld the submission of the defence and released the accused on bail each at the sum of N50,000 and two sureties in the same amount.
The court added that one of their sureties should be Civil Servant of Grade Level 8. The court adjourned the case to September 12 for further mention.
