Two Remanded For Gang-Raping 12-year-old Girl in Ilorin

An Ilorin Magistrate's court has remanded Tosin Fagbemi, 25,and Majeed Babatunde, 40, for allegedly gang raping a 12- years- old girl at Osere area of Ilorin, the Kwara state capital Their accomplice simply identified as Tunde, is presently at large.

Fagbemi and Babatunde were charged for criminal conspiracy and unlawful sexual intercourse with a child, contrary to section 96 of penal code law and section 31 (1), (2) & (3) of Kwara State Child's Rights Law 2006 .

Babatunde was not, however, in court as he was said to be receiving treatment in a hospital due to the treatment melted on him by the angry mob which apprehended him. The Police First Information Report (FIR) revealed that the mother of the victim reported the matter to the Police before it was referred to Anti-Human Trafficking, Women and Children Protection unit for secret investigation. The Police report noted that the complainant who resides at Osere area, Ilorin reported that on 7th January, 2019, her daughter was attacked while going home by the second accused, Fagbemi who also resides in the same address.

According to the FIR, Fagbemi took the girl to a room where the first accused , Babatunde and Tunde whose surname and address is still unknown forcefully had sexual intercourse with her. In the course of the investigation, Babatunde confessed to the crime and being the only one who had canal knowledge of the girl. The prosecutor, Sgt. Oderinde Abideen informed the court that the offence preferred against the accused is not ordinarily bailable. He also urged the court to remand the accused pending the time police investigation will be completed on the matter.

On his part, counsel to the accused , A.Y Sulyman informed the court that he will come formally for bail application of his client. Magistrate Esther Kikelomo Abu in her short ruling refused to take oral application from the accused person's counsel. She ordered that the suspects be remanded in prison custody and adjourned the matter to 29th January 29 .
