Kwara v CJ: Supreme Court Rules Tomorrow
The Supreme Court will tomorrow deliver its judgment in the case filed by the Kwara State Chief Judge, Justice Raliat Elelu-Habeeb, challenging the propriety of her removal from office.
It would be recalled that the then Governor of Kwara State, Bukola Saraki, had on May 5, 2009, removed Justice Elelu-Habeeb from office over alleged official misconduct and subsequently swore–in Justice Fola Gbadeyan in her place.
Following that, Justice Elelu-Habeeb had gone to the Federal High Court, Ilorin, alleging unlawful removal from office by the State Government and asking the court to declare her removal null and void and of no effect whatsoever. The suit was upheld by the federal high court presided over by Justice Bilikisu Bello.
The matter went on appeal at the instance of the State Government and the Court of Appeal while also ruling in her favour held, however, that the Federal High Court lacked jurisdiction to entertain the matter and said that it should have been filed at the State High Court.
Further protesting the observation, Justice Elelu-habeeb went to the Supreme Court seeking a determination of the jurisdiction of the court with regard to the matter in contention.
The appeal was heard by the Supreme Court on November 28 2011 by a panel of seven justices presided over by Justice Mohammed Mahmud JSC and judgment will be delivered tomorrow.
