APC Asks Court To Order Postponement Of Kwara LG Poll
The All Progressives Congress (APC) in Kwara State has asked an Ilorin High Court to stop the State Independent Electoral Commission (KWSIEC) from conducting the local government elections slated for October 26 and hold the elections at a later date.
The party is claiming that the KWSIEC 150 days notice of election is inconsistent with the dictates of Section 30(1) of the Electoral Act, 2010 (as amended).
Justice Abiodun Adebara has fixed September 24 for commencement of hearing.
APC and other claimants represented by a team of lawyers led by Timothy Gbadeyan prayed the court to "mandate KWSIEC to issue a fresh notice of election in the 16 local government areas of the state pursuant to Kwara State Electoral Law 2013 (as amended). "An order restraining the Peoples Democratic Party (PDP), PDM and Independent Democratic (ID) from taking fresh steps in anticipation of the 26th October, 2013 election or going further with the timetable and schedule of activities for the 2013 local government election as directed by KWSIEC pending the final determination of this action and / or new date of election as may be directed by KWSIEC pursuant to any order that this court may deem fit to make in the circumstance."
The claimants in a written address to support their originating summons averred that "KWSIEC's unsigned, undated and merely issued guidelines for the conduct of the local government election 2013 and also the unsigned and undated timetable and schedule of activities are null, void, ineffectual and should be discountenanced in their entirety in the conduct of any Kwara State local government election.
