APC Ilorin South: Relief as Supreme Court strikes out appeal against Aladi
The Supreme Court has struck out an appeal filed against Maryam Yusuf Aladi, a state House of Assembly candidate in Ilorin South.
The panel of judges led by Justice Kudirat Kekere-Ekun gave the verdict on Monday in suit Number SC/CV 181/2023.
Other members of the panel are Lawal Garba, Musa Abaji, Ibrahim Saulawa, Emmanuel, Agim J., and Adamu Jauro.
While Shina is the appellant in the suit, Aladi, the Independent National Electoral Commission (INEC) and the All Progressives Congress (APC) are respondents respectively.
Earlier, Aladi had emerged as the APC state assembly candidate during the party's primaries held last year, having defeated Hon A. Shina.
But dissatisfied with the outcome, Shina headed for the Federal High Court Ilorin where he lost the legal battle to Aladi.
When he approached the appellate court, the Appeal Court also upheld the decision of the lower court.
At the hearing in Abuja on Monday, L. O. Akangbe, Esq. appeared for the appellant, while Magaji Oba Abdulkadir and MA Yusuf appeared for Aladi and INEC, respectively.
At the hearing, the panel asked the appellant what he intend to achieve by this case, bearing in mind the prayers before the court and the provision of the constitution which provides for 180 days to hear grievances at the trial court.
The apex court insisted that it did not have the power ab initio to attend to the case based on the reliefs sought by the appellant.
But the Appellant through his counsel insisted that the court hears other issues in the appeal, a move that was resisted by the court.
Consequently, the appellant was told by the panel of Judges to do the needful by withdrawing the appeal, saying it was sheer waste of court's time
The appellant's counsel yielded and the appeal was struck out.
