The Federal High Court sitting in Ilorin, Kwara Sate, on Thursday struck out a suit filed before it by the Kwara State House of Assembly member, Abdulrazeez Oluwanilo, and the All Progressives Congress, challenging the recognition of Abdulraheem Agboola of the Peoples Democratic Party as member representing the Ilorin south constituency in the assembly.

Recall that in November last year, the Court of Appeal sitting in Ilorin nullified the election of Oluwanilo as the member representing Ilorin south and declared Agboola of the PDP as winner of the election.

The court also ordered INEC to issue a fresh certificate of return to the PDP candidate and the INEC had obliged.

However, after alleged pressure from the state government to force the PDP member from defecting to APC had failed, the assembly had refused to recognise Agboola as member.

The APC and the state government also instituted a suit against the court order claiming that the man sacked by the tribunal and the appeal court was not the one in the assembly representing Ilorin constituency.

The Federal High Court, however, in a judgment delivered by Justice Babagana Achiga, struck out the suit for lacking merit, describing it as gross abuse of court processes .

The court also ordered the Kwara Assembly Speaker, Yakubu Danladi, to immediately swear in Agboola, having satisfy all eligibility criteria to be sworn in as the member representing Ilorin south constituency.
